By downloading, installing, or using NestPilot AI (the "App") or visiting blackdata.info/apps/nestpilot-ai.html (the "Site"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and BlackData LLC ("we," "us," or "our"). If you do not agree, do not use the App or Site.
NestPilot AI is intended solely for parents and guardians who are 18 years of age or older. By using the App you represent and warrant that you are at least 18 years old. The App is not directed to, and should not be used by, children under 18. If you are under 18, do not use this App.
You may create an account using Apple Sign In, Google Sign In, or an email address. You are responsible for:

NestPilot AI offers auto-renewing subscription plans:
Subscriptions are purchased and managed through the Apple App Store or Google Play Store. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. The renewal charge will occur within 24 hours prior to the end of the current period at the rate of the selected plan. Prices are in USD and may vary by country or region.
We may offer a free 7-day trial for new subscribers. The trial begins at account creation. If you do not cancel before the trial period ends, you will be automatically charged for the subscription plan you selected. You may only use a free trial once per Apple ID or Google account.
To cancel your subscription:
Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date. We do not issue refunds for partial billing periods. Refund requests must be directed to Apple or Google per their respective refund policies:
NestPilot AI uses artificial intelligence (Google Gemini) to generate responses, meal plans, message rewrites, document summaries, and other content. AI-generated content may be inaccurate, incomplete, or inappropriate for your situation. You should independently verify any important information before acting on it. We make no warranty as to the accuracy, reliability, or completeness of AI-generated content. Your use of AI features is entirely at your own discretion and risk.
NestPilot AI provides general informational and organizational support only. Nothing in the App or on the Site constitutes:
You should not delay seeking professional advice because of information provided by NestPilot AI.
You retain full ownership of any content you submit to the App, including family profiles, messages, photos, and documents ("User Content"). By submitting User Content you grant us a limited, non-exclusive, worldwide license to process, store, and transmit that content solely as necessary to provide the features you request. You represent that you have all rights necessary to submit the User Content and that it does not violate the rights of any third party.

The App, Site, and all content, features, and functionality (excluding User Content) are owned by BlackData LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our intellectual property without our express written permission.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLACKDATA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.
You agree to indemnify, defend, and hold harmless BlackData LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms or for any operational reason. Upon termination, your right to use the App ceases immediately. You may request deletion of your account and data at any time via our Data Deletion page or by emailing support@blackdata.info.
These Terms are governed by the laws of the United States and the State of Utah, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and may provide additional notice in the App. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
